Global Flight Control L.L.C. — Effective October 25, 2026

These Terms of Service (“Terms”) govern your use of the flight-following, dispatch communication, and aviation safety services provided by Global Flight Control L.L.C. (“GFC,” “we,” “us”) through our mobile applications and related services (the “Services”). By creating an account or using the Services, you agree to these Terms.

The Services are intended for use by certificated pilots and other approved members. You agree to provide accurate registration information, to keep your account credentials secure, and to notify us of any unauthorized use of your account. You are responsible for activity that occurs under your account.

GFC provides supplementary flight-following, communication, and safety-awareness services. The Services are not air traffic control, are not a substitute for official FAA flight plans, search-and-rescue services, flight service stations, or any governmental or regulatory service, and do not relieve the pilot in command of any responsibility. As pilot in command, you remain solely responsible for the operation and safety of each flight, for all operational decisions, and for compliance with all applicable regulations, including 14 CFR § 91.3. Information provided through the Services, including weather and advisory information, is supplementary in nature and may be delayed, incomplete, or unavailable; you must not rely on it as your sole source of operational information.

The Services depend on third-party networks and infrastructure, including cellular, internet, and satellite communication systems, and on position and other data transmitted from your devices and equipment. We do not guarantee that the Services will be uninterrupted, timely, or error-free, and coverage limitations, equipment failures, and network outages can prevent or delay communications, including during an active flight.

If you provide your mobile phone number, you consent to receive service-related text messages from GFC, including dispatch communications, safety advisories, and account notifications. Message frequency varies with your use of the Services. Message and data rates may apply. Reply STOP to opt out and HELP for assistance. Opting out of text messages may limit our ability to reach you during an active flight-following engagement. Our collection and use of phone numbers is described in our Privacy Policy.

Certain features of the Services require a paid subscription. Subscription fees, billing periods, and renewal terms are presented at the time of purchase. Except where required by law or expressly stated otherwise, fees are non-refundable. We may change subscription pricing with notice effective at your next renewal.

You agree not to misuse the Services, including by: providing false flight or emergency information; using the Services in violation of law or regulation; interfering with the operation or security of the Services; attempting to access accounts or data belonging to others; or reselling the Services without our written permission. We may suspend or terminate accounts that violate these Terms or that create risk for GFC, our members, or our personnel.

You retain ownership of the information you submit to the Services. You grant GFC a license to use that information to provide and operate the Services as described in our Privacy Policy, including the use of de-identified and aggregated data for safety analysis and service improvement.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GFC DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE, TIMELY, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GFC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR OPERATION OF AN AIRCRAFT OR RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GFC’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO GFC FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access to the Services for violation of these Terms, for risk or security reasons, or upon discontinuation of the Services, with notice where practicable. Provisions that by their nature should survive termination, including disclaimers and limitations of liability, survive.

We may update these Terms from time to time. We will post updated Terms here with a revised effective date and will provide additional notice of material changes where required. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States and the state of GFC’s organization, without regard to conflict-of-law principles.
